Terms of Service

These Terms of Service ("Terms") apply to your use of the Voicely website and to the AI receptionist and automation services provided by Voicely AI Reception ("Voicely", "we", "us"). By using our website or services, you agree to these Terms. If you are using our services for a business, you confirm you are authorized to accept these Terms on its behalf.

1. Our services

Voicely sets up and manages AI receptionists and related automations for businesses. The specific features, integrations and allowances for each client are those of the plan they choose and any written proposal or service agreement we agree to. If a service agreement conflicts with these Terms, the service agreement applies.

2. Website demos

  • "Get an AI call": by submitting a phone number and ticking the consent box, you confirm the number is yours (or you are authorized to use it) and agree to receive one automated demo call. Standard carrier rates may apply.
  • "Talk to the AI": the browser demo uses your microphone with your permission and is provided for evaluation only.
  • Demos may be changed, limited or turned off at any time. Please don't use them to test with other people's phone numbers or to place excessive calls.

3. Plans, fees and billing

  • Prices are in Canadian dollars (CAD) and are before applicable taxes.
  • Each plan has a one-time setup fee and a monthly fee. Custom plans are priced in a written proposal.
  • Each plan includes a monthly allowance of AI voice minutes. Unused minutes do not roll over.
  • Additional minutes are billed at the rate shown on our pricing page (currently C$0.65 per minute). We alert you at 80% of your allowance, and larger overages require your approval.
  • Some costs are billed separately when they apply, such as SMS and WhatsApp messaging charges, additional phone numbers, paid third-party subscriptions, major workflow changes and custom development.
  • Plans are month-to-month with no long-term contract. You can cancel at any time; your plan stays active until the end of the billing period you've already paid for.
  • The one-time setup fee covers building and launching your receptionist. Promotional offers, such as our founding-client offer, apply as described on our pricing page.
  • Payment timing and any refunds are set out in your service agreement or proposal.

4. Your responsibilities

  • Provide accurate business information, such as services, hours, policies and pricing guidance, and tell us when it changes.
  • Make sure your use of the service follows the laws that apply to you, including privacy, call-recording, telemarketing and anti-spam laws (such as CASL), and any rules in your industry.
  • Give callers any notices, and obtain any consents, that your industry or location requires.
  • Not use the service for unlawful, harmful, deceptive or abusive purposes, including unsolicited bulk calls or messages.

5. Important limits of AI

AI receptionists can misunderstand callers, give incomplete answers or make mistakes. They follow the rules and information you provide, and you should review call summaries and bookings regularly. Our AI receptionist is not an emergency service. Callers with an emergency should contact 911 or the appropriate emergency service. Features that depend on third parties, such as texting, call recording, call transfers and integrations, depend on platform, provider and regional support and may not be available in every case.

6. Third-party services

Our services rely on third-party providers for voice AI, telephony, scheduling, messaging and integrations. We are not responsible for outages, changes or charges caused by those providers, but we will work with you to minimize any impact.

7. Intellectual property

Voicely owns our website, branding, software, call-flow designs and know-how. You keep ownership of your business information and your customer data. You give us permission to use them only as needed to provide and improve the services for you.

8. Privacy

Our Privacy Policy explains how we handle personal information, including caller information we process on your behalf.

9. Disclaimers and limitation of liability

Except as expressly stated in a service agreement, our website and services are provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. To the extent permitted by law, Voicely is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, bookings or data. Our total liability for any claim relating to the services is limited to the fees you paid us for the services in the three (3) months before the claim arose.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. Continued use of our website or services after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
